Terms of Service
These terms are written to be read. If anything here is unclear, ask us at dev@pockadot.com before you agree to it.
1. Who we are
Textmux is operated by Pockadot LLC, a limited liability company organized in the State of Washington, USA ("Textmux", "we", "us"). These Terms of Service are an agreement between Pockadot LLC and you, the person, company, or automated agent operator using the service ("you", "your"). By creating an account or using the API, you accept these terms.
2. The service
Textmux is an SMS API for transactional messages and messages to recipients who opted in: order updates, verification codes, appointment reminders, and notifications your recipients asked for. We provide API access, sender registration and carrier verification filed on your behalf, sending and receiving infrastructure, delivery events, message logs, and suppression management.
Service is prepaid by credits, where one credit covers one SMS segment. Credits can be purchased by card or by x402 payment.
3. Your account
- Give us accurate account and sender registration information and keep it current. Carrier verification depends on it being true.
- Keep your API token secret. Anything sent with your token is your responsibility, so rotate it immediately if you think it leaked.
- You must have the authority to accept these terms for the entity you register, whether you are a person or an automated agent acting for one.
4. Acceptable use
Textmux exists to keep a clean sending pool. Consent is the rule: every recipient must have asked for, or transacted their way into, the message you send them. The following are prohibited, on every plan, with no exceptions:
- Cold outreach. Messaging people who never opted in, no matter how targeted or personalized.
- Purchased lists. Bought, rented, scraped, or appended recipient lists.
- Carrier-prohibited content, including sex, hate, alcohol, firearms, tobacco and vape, cannabis, and gambling content.
- Phishing, fraud, deceptive sender identities, or content that is illegal under applicable law (including the TCPA and CTIA messaging guidelines).
Opt-outs are honored automatically: STOP replies suppress the recipient immediately, and suppressed sends are never delivered and never charged. You must not attempt to work around a suppression.
5. Enforcement
We review senders before they can send and monitor delivery health automatically. When something needs enforcement, it follows a published ladder: warn, then restrict, then pause.
Our enforcement policy is built on transparency. We make reasonable efforts to provide the specific reason for any enforcement action (a warning, restriction, or pause) and, except in cases of egregious abuse or where we are legally constrained, a window to fix the problem. Rejected sender applications always include the reasons. Appeals go to dev@pockadot.com and are answered by humans.
6. Phone numbers
- Dedicated numbers are provisioned for your use and registered to your business identity through carrier verification programs.
- Your dedicated number is portable. If you leave Textmux, you can port it to another provider; we will cooperate with the port.
- While your verification is in review, messages may route through our shared, verified number pool, subject to pool sending limits, and cut over to your number on approval.
- Shared pool numbers remain ours and may be reassigned; dedicated numbers are held for you while your registration is active.
7. Fees and billing
- Pricing is flat per segment with carrier fees included, published on this site. Credits are prepaid and drawn down as you send.
- Segments are computed with standard GSM-7 and UCS-2 encoding rules, matching what carriers transmit.
- Messages that fail to deliver are refunded automatically. Suppressed sends are never charged.
- Card payments are processed by our payment processor. We never store your full card details.
- We give at least 30 days' notice before a price change affects published rates. You are responsible for any applicable taxes.
8. Your content and data
You keep all rights to the content you send. You grant us only the limited rights needed to operate the service: to process, transmit, and log your messages on your behalf, and to submit your sender registration information to carrier verification programs. We process recipient data as described in our Privacy Policy. In short: message logs are kept for 90 days, suppression lists are kept so opt-outs stick, and aggregate statistics are kept to run the service.
You are responsible for having the legal basis (consent, or a transaction) to message every recipient you send to through Textmux.
9. Availability
The service is provided "as is" and "as available", without warranties of any kind, express or implied. We work hard to keep Textmux up, but we do not guarantee uninterrupted or error-free operation, and we may change, suspend, or discontinue features. Message delivery ultimately depends on mobile carriers we do not control.
10. Limitation of liability
To the maximum extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of the service is limited to the fees you paid us in the three months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Termination
You can close your account at any time. We can suspend or terminate your account for violations of the acceptable use policy, for non-payment, or where the law requires it, following the enforcement policy in section 5. After closure, your data is deleted on the schedule in the Privacy Policy, and your dedicated number remains portable during a reasonable wind-down window. Sections 8, 10, and 13 survive termination.
12. Changes to these terms
We may update these terms as the service evolves. The current version always lives at this page, with its effective date at the top. For material changes we will notify account holders before the change takes effect. Continued use after the effective date means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Washington.
